Merger clearance and authorisation application forms
We have developed new merger clearance and authorisation forms to give us upfront in an application the minimum relevant information and documents we need from merger parties.
Where we receive applications seeking clearance or authorisation of mergers or acquisitions under the Commerce Act 1986, an application is required to include the information and documents required by us in prescribed applications forms.
Following consultation, we have published new application forms for clearance and authorisation of mergers or acquisitions, along with updated guidance on filing an application.
Our new application forms and guidance on filing an application seek to:
- incorporate information that we are likely to require from merger parties prior to the registration of an application
- provide certainty and transparency for merger parties on the information that we will likely need to assess an application
- allow a degree of flexibility in the level of detailed information and documents required in (and with) an application, depending on the circumstances, nature and complexity of a specific merger or acquisition
- highlight the benefits of engaging with us in pre-notification discussions, so that we can provide feedback on the information and evidence (and supporting documents) we are likely to need in (and with) an application
- assist in improving the efficiency and timeliness of our assessment of applications by giving us upfront the minimum relevant information of the merger parties
These new application form requirements apply to applications registered from 1 July 2026.
