The Commission has undertaken an investigation under the Fair Trading Act relating to the enforcement of potentially unfair contract terms against a small business customer contained in the trader’s small trade contract for collection services. The Commission has identified terms in the contract that a court may find ‘unfair’, engaged with the trader about these terms and provided the trader with compliance advice.
