The Commission has accepted court enforceable undertakings from NZ Sale Limited and OZSale Pty Ltd to resolve its investigation(s) under sections 13(a), 13(g), 30(1) and 12A of the Fair Trading Act. NZ Sale Limited and OZSale Pty Ltd are part of the Mysale Group and operate the website www.nzsale.co.nz (and at the time of the investigation also a physical store) in New Zealand. The investigation related to the sale of counterfeit Beats headphones, the use of strikethrough prices which the Commission considers were unable to be substantiated and the sale of Children's Nightwear which failed to comply with the Children's Nightwear and Limited Daywear Having Reduced Fire Hazard Regulations 2016 between September 2016 and September 2019.
