Commission to issue SoUI on Godfrey Hirst’s proposed acquisition of Bremworth
The Commerce Commission has decided to issue a Statement of Unresolved Issues relating to a clearance application from Mohawk Industries, Inc. seeking clearance for it, or any interconnected body corporate of Mohawk, to acquire 100% of the shares of Bremworth Limited.
In New Zealand, one of Mohawk’s interconnected bodies corporate is Godfrey Hirst New Zealand Limited.
The Statement of Unresolved Issues will be published on the Commission’s case register in due course and will outline the Commission’s provisional competition issues with the proposed acquisition. The Statement of Unresolved Issues will invite submissions from Godfrey Hirst, Bremworth and other interested parties.
The Statement of Unresolved Issues is not a final decision and does not mean that the Commission intends to decline or clear the application for clearance.
The Commission was scheduled to make a decision on the application by 2 April 2026. However, an extension of time has been agreed between the Commission and Godfrey Hirst. The new decision date is 29 May 2026.
Background
Both Godfrey Hirst and Bremworth manufacture and supply a range of carpets to customers in New Zealand.
We will only give clearance to a proposed merger if we are satisfied that the merger is unlikely to have the effect of substantially lessening competition in a market.
