Mobile trader Xtreme Deals Limited t/a Xtreme Kiwi Deals has been warned for likely breaches of the responsible lending principles and for using unfair contract terms in its purchase agreement. The Commission has also accepted court enforceable undertakings from Xtreme Kiwi Deals not to enter into consumer credit contracts that contain Delayed Delivery Provisions (defined in the undertakings), or rely upon or enforce the Delayed Delivery Provisions in any contracts already entered into, and remediate some customers who were charged “administration fees” when they cancelled their contracts. The Commission has also accepted enforceable undertakings from Xtreme Kiwi Deal’s Director.
