The Warehouse Limited
The Warehouse Limited has been fined $234,000 for breaching s 30(1) of the Fair Trading Act, by supplying, offering to supply, and advertising to supply toys that did not comply with the prescribed product safety standard. The toys had labelling attached with an image of a baby playing with one of the toys. The Commission alleged the toys were manufactured, designed, labelled, or marketed for use by children up to and including 36 months of age whilst containing small components that may create a choking hazard for young children. The sentence followed guilty pleas being entered to nine representative charges.
The Warehouse offered to provide enforceable undertakings under section 46A of the Fair Trading Act, which the Commission accepted, in order to address the Commission’s concerns regarding The Warehouse’s compliance with the Regulations in relation to sale of toys in the future.
