Spark has been warned for likely breaches of sections 11, 13(e) and 13(h) of the Fair Trading Act. Spark engaged in conduct liable to mislead the public as to the suitability of its wire maintenance service by making misleading representations on its website or on invoices to its wireless and fibre connection customers about the use, benefit or need for wire maintenance service. The Commission has also accepted court enforceable undertakings from Spark to provide refunds to customers who may have been charged with no use, need or benefit for the service.
