Home Direct Limited
The Commerce Commission has obtained the first unfair contract term declarations under the unfair contract term provisions of the Fair Trading Act against mobile trader Home Direct Limited (Home Direct). The High Court found the terms and conditions relating to refunds and expiry of vouchers for its “Voucher Entitlement Scheme” were unfair under section 46L(1) of the Act.
