The Wellington High Court has made declarations that certain cancellation terms, used at times between October 2019 until April 2025 in Bachcare’s Terms & Conditions, were Unfair Contract Terms. The proceedings related to contract terms that address the entitlements of consumers when bookings were cancelled by Bachcare, the guest, the property owner, or could not otherwise go ahead for reasons beyond their control. The Commission reached a settlement with Bachcare and the parities jointly asked the High Court to make the agreed declarations.
