ANZ Bank New Zealand Limited (ANZ) has been warned by the Commission for likely breaches of the Credit Contracts and Consumer Finance Act 2003 (CCCF Act) and the Fair Trading Act 1986 (FT Act) in relation to two self-reported issues. The likely breaches relate to ANZ’s obligations under section 9C of the CCCF Act to exercise the care, skill and diligence of a responsible lender. For one of the self-reported issues, the likely breach also relates to ANZ’s obligation to not mislead consumers about the existence of a right under the FT Act.
