The TDL replaces the Telecommunications Service Obligations (TSO) liability allocation process and streamlines the process for industry contributions to the TSO, RBI, and other government led improvements to New Zealand's telecommunications infrastructure.
The Commission is required to prepare an annual TDL liability allocation determination (LAD) in accord with subpart 2 of Part 3 of the Telecommunications Act 2001.
Under subpart 2 of Part 3 of the Telecommunications Act 2001, the Commerce Commission is required to prepare a TDL LAD at the end of each financial year.
Sections 82 and 83 of the Act require specific groups of liable persons to provide the Commission with financial information to assist with completing this requirement.
Sections 84 and 87 require the Commission to prepare draft and final versions of this liability allocation determination. The TDL LAD is the mechanism the Crown to establish the amount of the TDL each qualifying liable person is required to pay.
