The Commerce Commission made standard terms determinations (STDs), under section 30M of the Telecommunications Act 2001 (the Act) in respect of the designated access services of:
- Telecom's unbundled copper local loop network (UCLL) on 7 November 2007
- Telecom's unbundled bitstream access (UBA) on 12 December 2007
- Telecom's unbundled copper local loop network service (Sub-loop UCLL), Telecom's unbundled copper loop network co-location (sub-loop co-location)
- Telecom's unbundled copper local loop network backhaul (distribution cabinet to telephone exchange) (together the sub-loop services) on 18 June 2009.
On 30 June 2011 the Telecommunications (TSO, Broadband, and Other Matters) Amendment Act 2011 (the Amendment Act) received Royal Assent. Sub-sections 73(1) and 73(2)(b) of the Amendment Act require that the Commission review Decisions 609, 611 and 672 under section 30R of the Act, for the purpose of averaging the core prices paid under these Decisions (in contrast to the current prices, which are geographically de-averaged).
The geographically averaged price will come into effect for the UBA STD on separation day and for the UCLL and Sub-loop Services STDs three years after separation day.
The Commission has undertaken two reviews in relation the UCLL, UBA and sub-loop services STDs. The first review will determine the geographically averaged prices and was started on 7 July 2011 - for the UBA STD this involves updating the uplift that applies to the price for the UBA service variants without POTS. At that time the Commission advised that it would be updating its benchmarking for the purposes of this review.
On 25 August 2011 the Commission announced that a complementary review of the benchmark set was being started. The review will update the monthly UCLL prices and UCLL connection charges to reflect movements in prices internationally, and update prices under the UCLL and Sub-loop Services STDs that are affected by the UCLL benchmark data update.
On 25 August 2011 the Commission also announced that it intended to release draft decisions for these reviews for the UCLL and UBA STDs on 2 September 2011. The draft review was released on 9 September 2011. A draft decision for these reviews for the sub-loop services STD will be released separately later in 2011 (as there has been no uptake of sub-loop services, this review has been allocated a lower priority).
