We will consider whether to include the Divestment Guidelines (PDF) and Failing Firms Guidelines (PDF), revised as appropriate in the updated guidelines. The Commission will then consider developing draft guidelines for consultation next year in light of the comments received in the current consultation.
The Commission intends to reflect recent court judgments and its own current practices in the draft updated guidelines.
The Commission will also have regard to recent overseas updates to merger guidelines, for example:
- Australian Competition and Consumer Commission Merger Guidelines (2008)
- UK Competition Commission / Office of Fair Trading (2010) Merger Assessment Guidelines (PDF)
- US Department of Justice / Federal Trade Commission Horizontal Merger Guidelines (2010)
