On 2 February 2012 the Commerce Commission released the discussion document Determining the liability allocation for the Telecommunications Development Levy for 2011/12 and beyond. This document described how the Commission proposed to operate the new Levy’s liability allocation determination process. A consultation process was engaged, with submissions and cross-submissions being invited from interested parties.
The Commission received submissions from a number of parties, raising a variety of issues. In order to address those issues in a methodical and transparent manner the Commission expanded the development process to deal with them specifically. These issues included identifying the liable persons that qualify to pay a proportion of the TDL, and establishing the qualified revenue framework the Commission will use to calculate how much qualifying liable persons will be required to pay.
