Consequential changes review of STDs

Section 72 of the Amendment Act required that the Commission review a range of STDs under section 30R of the Act in order to give effect to changes made by the Amendment Act.  These changes were principally concerned with the de-merger of Telecom and new pricing principles for regulated services.

 The Commission requested that the Telecommunications Carriers’ Forum (TCF) facilitate an industry led process to agree on the changes. The TCF provided the Commission with a variety proposed changes which formed the basis of the Commission’s review launched on 26 September 2011.  The following standard terms determinations were updated by this review:

• the UCLL STD (Decision 609)
• the UCLL co-location STD (Decision 610)
• the UBA STD (Decision 611)
• the UCLL backhaul STD (Decision 626)
• the UBA backhaulSTD (Decision 627)
• the Sub-loop services STD, which includes the SLU UCLL service, SLU co-location service, and SLU backhaul service (Decision 672).

 The Commission’s final Decision on Consequential Changes to Commerce Commission Standard Term Determinations was released on 24 November 2011.

Contemporaneous with this review, the Commission completed a separate review, the UCLL averaging review, as required by s73(2)(b) of the Amendment Act. The changes to the UCLL price (to have effect from 3 years from separation), and their flow-through to the UBA price, have been reflected in the revised documents released with this decision.
