Benefits and Detriments Guidelines

The development of new guidelines for the analysis of public benefits and detriments has been put on hold pending the outcome of a major application for authorisation (Kotahi Logistics). In the interim, in considering applications for authorisation, the Commission continues to use the principles contained in previously published guidelines. These can be viewed below.

The purpose of this paper is to draw up a set of guidelines for use in assessing the public benefits and detriments arising from a lessening in competition or an acquisition or strengthening of dominance, in context of authorisation applications under ss58 and 67 respectively of the Commerce Act 1986.
