Assessment Against Thresholds 2001-04

Under subpart 1 of Part 4A (repealed), the Commerce Commission implemented a targeted control regime. As part of that regime, the Commission set thresholds, assessed lines businesses against these thresholds, identified any lines business that breached the thresholds, and determined whether or not to make a declaration of control in relation to any identified lines business.

The incentives to achieve compliance with the thresholds set by the Commission were to some extent dependent on the consequences of breaching the thresholds perceived by the lines businesses. The Commission therefore considered that some certainty in relation to post-breach consequences was necessary and desirable if the aim of the targeted control regime under subpart 1 of Part 4A of the Act was to be met.
