Development of Input Methodologies

The Commerce Amendment Act 2008 amends the regulatory control provisions of the Commerce Act 1986. The amended provisions directly affect the regulatory approach to gas and electricity regulation, and extends the Commerce Commission’s responsibilities to include airport services. The Commerce Amendment Act received Royal Assent on 16 September 2008 and took effect from 14 October 2008. The provisions of the Commerce Amendment Act that regulate electricity lines services take effect from 1 April 2009.

June 2009: The Input Methodologies Discussion Paper was published for consultation on 19 June 2009. Submissions are due by 31 July 2009.

December 2008: A discussion paper providing an overview of the Act and discussing the Act and its implications was released for consultation on 19 December 2008. Process

Indicative timeframe

1.      

Regulatory Provisions of the Commerce Act:  Discussion paper published for consultation.  This paper provides an overview of the amended Act and its implications, including detail on the process for determining input methodologies. 

19 December 2008

2.      

Input Methodologies Discussion Paper published for consultation.
This paper discusses matters associated with evaluating or determining the cost of capital, valuation of assets, allocation of common costs, the treatment of taxation, and pricing methodologies, as set out in section 52T(1)(a) and (b) of the Act. Submissions are due by 31 July 2009.

19 June 2009

3.      

Conference on the Guidelines Discussion Paper.

Week commencing 14 September 2009

4.      

Cross submissions invited in response to the submissions received on the Discussion Paper.

Directly after submissions. Cross-submissions are due at 5pm, 17 August 2009.

5.      

Draft input methodologies for each type of regulated service published for consultation. 

Q4 2009/
Q1 2010

6.      

Determination of input methodologies for each type of regulated service, in accordance with section 52W of the Act.

By 30 June 2010
