The Commission’s Revised TSO Draft Determination for 2004/05, in
rejecting the inclusion of new technologies in the modelling process,
represents a substantive departure from its previous Determinations.
This fundamental change was driven by the Commission’s belief that
Telecom is not sufficiently compensated via the expected depreciation
captured by asset tilts for the introduction of new technologies. While
we agree that the Commission’s approach to exclude new technologies
from the TSO model may both ensure that Telecom is not at risk of
under-compensation for its TSO business as well as simplifying the
modelling process, it is less clear that in taking this approach the
requirements of the Telecommunications Act 2001 are fully satisfied.

In our review of Telecom's submission on the Commerce Commission paper Refinement of the MT Cap, we find that Telecom focuses mainly on the issues of prinicple as opposed to the specific modelling issues raised by the Commission. In doing so it reverts to many of the matters that were subject of early submissions and conferences in the history of the Commission's implementation of the TSO.

The Commission’s December 4 discussion paper is narrowly focussed on modelling issues associated with the MT cap. Telecom also notes that the approach to new technologies being proposed by the Commission raises some fundamental conceptual and legal issues which need to be addressed. These fundamental issues are discussed section 2 and 3 of this paper. Telecom discusses modelling issues raised in section 4 of this paper.

Network Strategies believes that the Commission has made significant progress in addressing key difficulties inherent in the calculation of wireless cost caps for TSO modelling. In general, we agree with the Commission’s assumptions underlying refinement of the mobile technology (MT) cost cap calculation, particularly that radio infrastructure can be shared between exchange areas and the recognition that incremental cost modelling must take into account Telecom’s existing mobile and other radio station infrastructure.

TelstraClear (TCL), Vodafone and Network Strategies (NSL) have all raised the issue of the Commission’s approach to modelling the mobile cap. In particular, the suggestion is that the Commission has failed to model the costs an efficient service provider would incur in serving commercially nonviable customers (CNVCs), because of the Commission’s approach to modelling the mobile cap.

This report elaborates on the revenue calculation for the 05/06 TSO. It is in four sections:
• Section 1 provides some details on improvements in methodology between 04/05 and 05/06 which have made the revenue estimate more accurate. In almost all instances these are minor but they reflect ongoing activity to ensure that the revenues used in the TSO are as accurate as possible.
