Cross Submissions to the Revised Draft
rejecting the inclusion of new technologies in the modelling process,
represents a substantive departure from its previous Determinations.
This fundamental change was driven by the Commission’s belief that
Telecom is not sufficiently compensated via the expected depreciation
captured by asset tilts for the introduction of new technologies. While
we agree that the Commission’s approach to exclude new technologies
from the TSO model may both ensure that Telecom is not at risk of
under-compensation for its TSO business as well as simplifying the
modelling process, it is less clear that in taking this approach the
requirements of the Telecommunications Act 2001 are fully satisfied.
