On 13 November 2002 under the Telecommunications Act 2001 TelstraClear Limited filed an application for an access determination concerning price and non-price terms for the residential local access and calling service offered by means of Telecom's fixed telecommunications network, retail services and bundles of retail services offered by means of Telecom's fixed telecommunications network, and retail services offered by means of Telecom's fixed telecommunications network as part of a bundle of retail services.
On 20 December 2002, under the Act, the Commission issued a Decision to Investigate the Residential Wholesale Application insofar as it concerns the residential local access and calling services, and individual retail services and specific bundles of services offered by means of Telecom's fixed telecommunications network, and not to investigate the Application insofar as it concerns retail services offered by means of Telecom's fixed telecommunications network as part of a bundle of retail services.
On 9 July 2003, Telecom and TelstraClear ("the Parties") advised that the Parties were continuing to commercially negotiate, and that TelstraClear would not require a determination until the conclusion of these further negotiations.
On 23 December 2003, TelstraClear filed with the Commission an application to resume the Commission's consideration of its application. Concurrent with the Commission's investigation, the Parties continued to commercially negotiate.
On 31 March 2004, the Parties informed the Commission that agreement had been reached on all aspects of the Application except for the services to be covered by the Parties' agreed residential supply terms, and the wholesale discount rates for those services.
On 16 April 2004, the Commission issued a Draft Wholesale Determination.
On 13 January 2006 Telecom and TelstraClear announced that they have entered into an agreement settling a number of applications that are currently being considered by the Commission. This commercial agreement affects the TelstraClear Residential Wholesale Pricing Review application dated 2 July 2004.
