On 16 May 2002, under the Telecommunications Act 2001 ("the Act"), TelstraClear filed an application for an access determination concerning price and non-price terms in respect of interconnection with Telecom's fixed PSTN and interconnection with TelstraClear's fixed PSTN, retail services and bundles of retail services offered by means of Telecom's fixed telecommunications network, and retail services offered by means of Telecom's fixed telecommunications network as part of a bundle of retail services.
On 11 June 2002, the Commission made an Order, under the Act, that the services named in the Application could be divided into "Interconnection" and "Wholesale" services, and that the Commission would consider separately these two types of services.
On 19 June 2002, under the Act, the Commission notified the parties that it had decided to investigate the TelstraClear Interconnection Application. The Commission also issued a decision not to investigate the Telecom Interconnection Applications, as the issues raised by the TelstraClear and Telecom applications could be dealt with through a single process.
On 2 September 2002, the Commission issued a Draft Interconnection Determination. A conference was held on the Draft Determination on 16 and 17 September 2002.
On 5 November 2002, the Commission issued its Wholesale Determination.
On 11 February 2003, the Commission issued a Decision to Clarify the Interconnection Determination under the Act. On the same date, the Commission issued a Decision not to reconsider the Determination under section 59(1)(b) of the Act.
On 13 January 2006 Telecom and TelstraClear announced that they have entered into an agreement settling a number of applications that are currently being considered by the Commission. This commercial agreement affects the following determinations. In accordance with section 54 of the Act TelstraClear has withdrawn the following application:
1. the TelstraClear Interconnection Pricing Review applications dated 15 November 2002;
